LISTING POLICIES

As a marketplace, Boribids is committed to connecting our valued gallery partners with our global collector base. Our Listing Policies are designed to help you achieve the most success on Boribids, and maintain the high level of trust collectors and other stakeholders have in us. 

Overview

Please follow these policies to keep your account in good standing:

• Authenticity: All works must be authentic. Any plagiarized, stolen, or fake listings may result in action on your account. You are required to accept a return and offer a refund if a sold work proves inauthentic.

• Right to List: Ensure you can pass clear title for each item you list and the right to sell each Item. You must be the owner of the artwork or have documentation confirming your right to sell it (such as a consignment agreement). Listing a work for purchase that you do not have the right to sell in order to solicit demand is not permitted.

• Cataloging: Accurately describe each work you list, including artist involvement, title, date, medium, dimensions, edition details, certificates of authenticity, condition, and availability. Create one listing per item or artwork, and do not include links directing away from Boribids.

• Inventory Requirements: Certain types of artworks, items, materials, and content cannot be listed.

• Image Requirements: Ensure your images accurately represent the item or artwork and comply with copyright law.

• Copyright: Boribids maintains a Digital Millennium Copyright Act (DMCA) compliance program, which applies to all Users.

Boribids has programs and tools in place to monitor marketplace activity and may reach out to request additional information. Failure to meet our Listing Policies are considered breaches of Boribids Terms and Conditions, and may result in negative actions on your Boribids account.

Inventory Requirements

We created our inventory requirements with input from artists and their representatives, focusing on what Boribids collectors expect when transacting on our marketplace. These guidelines apply to all gallery listings. They do not apply to auctions hosted by third parties.
 

The following types of art and design may be listed on Boribids:

• Unique works

• Limited, unknown, or open edition works

• Artist books and monographs 

• Out of print posters by artists recognized for working in the medium

• Merchandise and collectibles that are an important part of an artist’s practice, such as:

  • Skateboards

Boribids does not allow the following items to be listed:

• Any work created without the authorization of the artist or their estate, or which infringes on an artist’s copyright.

• Any Banksy work without a Certificate of Authenticity from Pest Control

• Ephemera (ex: signatures on mediums other than artworks, sketches/doodles, letters, postcards, announcement cards, flyers, vinyl records, etc.)

• Pages/plates removed from books, periodicals, or magazines

• Merchandise reproducing art (ex: keychains, scarves, pillows, clothing, kitchenware)

• Reproductions and museum replicas
   

Restricted Materials and Content

We understand that artworks often use provocative, offensive, or illicit materials to make a statement. Our mission is to build a marketplace that supports the vast diversity of artistic expression. However, in order to comply with state and country laws, there are some materials and items that are not allowed to be listed. 

The following materials may not be listed on Artsy in order to comply with state and country laws:

• Drugs, alcohol, or tobacco products

• Food products

• Explosives, guns, or other weapons

• Hazardous or toxic materials

• Currency, lottery tickets, or gambling equipment

• Bodily fluids or body parts

• Live animals

• Property containing material from plant or animal species protected as endangered or threatened under applicable local or national laws of the United States or any other jurisdiction. 

• Third-party identification documents or sensitive personal or financial information

• Embargoed goods or pre-embargoed goods from the following countries or regions:

  • Belarus

  • Cuba

  • Democratic People’s Republic of Korea (North Korea)

  • Iran

  • Russia

  • Syria

  • Ukraine: Crimea, Donetsk, and Luhansk regions (as defined under applicable sanctions)

Due to the nature of artistic expression, Boribids has a high threshold for restricting content. Artworks that violate the law or critical third-party service provider legal terms, and works that celebrate hate and were created with ill-intent will be removed by our team.
